These Terms of Service ("Terms") govern your access to and use of the websites, software, and services provided by Plus Bytes ("Plus Bytes," "we," "our," or "us"), including our AI automation and AI voice agent services and the Plus Mailer email outreach platform (collectively, the "Services"). By accessing or using the Services, or by purchasing a plan, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that any information you provide is accurate and complete.

2. The Services

Plus Bytes provides AI automation solutions, AI voice agents, and Plus Mailer, a platform for sending targeted email campaigns from your own domain, together with an associated business-listing lookup ("scraper") tool. Features, limits, and availability may change over time as we improve the Services.

3. Accounts

Access to paid features requires an account, which we provision for you. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly at info@plusbytes.com if you suspect any unauthorised use.

4. Plans, Pricing and Payment

• Paid plans are billed annually as a one-time payment in advance. Plans do not auto-renew; you renew each year by choosing to make another payment.
• Prices are listed in Indian Rupees (INR) and, where available, US Dollars (USD). Applicable taxes, including GST, are charged as required, and a tax invoice is provided.
• Payments are processed securely through our payment gateway, Razorpay. We do not store your full card or bank details on our servers.
• All fees are non-refundable except as set out in our Cancellation and Refund Policy.

5. Acceptable Use

The Plus Mailer platform is intended for legitimate business-to-business outreach. When using the Services, you agree that you will not:

• Send unsolicited bulk email, spam, or any message that violates applicable anti-spam, privacy, or data-protection laws in your jurisdiction and the jurisdiction of your recipients;
• Send content that is unlawful, fraudulent, deceptive, defamatory, obscene, or infringing on the rights of others;
• Use purchased, rented, or illegally obtained contact lists, or contact recipients without a lawful basis to do so;
• Impersonate any person or organisation, or misrepresent the origin of any message;
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Services or their infrastructure;
• Resell or sublicense the Services without our written permission.

You are solely responsible for the content you send, for your contact lists, and for ensuring you have the legal right and any necessary consent to contact your recipients. We may suspend or terminate accounts that violate this section.

6. Third-Party Services

The Services rely on third-party providers, including Razorpay (payments), Resend (email delivery), and Google (business-listing data and analytics). Your use of features that depend on these providers may also be subject to their respective terms and policies.

7. Intellectual Property

All rights, title, and interest in the Services, including software, branding, and content created by Plus Bytes, remain our property or that of our licensors. These Terms do not grant you any ownership rights. Content you upload or send remains yours, and you grant us a limited licence to process it solely to provide the Services.

8. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or that any particular delivery, open, or response rate will be achieved. Business-listing and email-discovery results are provided for convenience and are not guaranteed to be complete or accurate.

9. Limitation of Liability

To the maximum extent permitted by law, Plus Bytes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a manner that creates legal or security risk. On termination, your right to use the Services ends. Fees already paid are non-refundable except as stated in our Cancellation and Refund Policy.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
